Secure Payments

Millican uses Shopify Payments and PayPal to ensure your order is processed securely. All transaction information passed between our site and the Shopify Payments and PayPal systems are encrypted using 128-bit SSL (Secure Socket Layer) certificates. Simply put, no information entered into the Shopify Payment or Paypal systems can be examined, used or modified by anyone else (including ourselves) attempting to gain access to sensitive information. Our Shopify site is also fully PCI DSS Compliant, a Payment Card Industry security standard which helps prevent fraud. More information can be found on www.shopify.co.uk/pci-compliant.

We also offer a 'Buy now, pay later' option via Klarna, Terms and Conditions of which can be found here. In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our site, and in the materials published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. If you’d like to print off a copy, or download any extracts of any pages from our site for your personal reference, we’d be delighted. Whenever you refer to our site and this printed or downloaded material, please can you make sure you acknowledge ourselves as the authors (or the author referenced) of the materials, which also helps spread the Millican word. None of the materials or part of the materials on our site can be used for commercial purposes without us providing you with a license to do so.

Gift Vouchers

Millican Gift Vouchers can be redeemed exclusively at homeofmillican.com and are valid for 6 months from the date of purchase (as stated on the voucher). The unique voucher code can be entered into the required box at the checkout on the Millican website. Any unused balance will be recorded against the voucher code for a second use. There is no cash redemption value. Millican Outdoor Limited reserve the right to cancel a gift voucher at any time, the customer will be fully refunded if this were to occur. Terms and Conditions of Online Sales

1. General

1.1. These are the terms and conditions of sale of Millican Outdoor Limited (trading as Millican), whose registered office is at The Shed, Braithwaite New Farm, Keswick, CA12 5RY, United Kingdom. Registered with VAT Number GB368572847. These terms apply to all online purchases of Millican goods made using www.homeofmillican.com. We recommend that you read this document carefully before placing your order.

1.2. By placing an order through our site, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old.

2. Your Order

2.1. Every order you place on this website will be subject to acceptance in accordance with these Terms and Conditions. The final details of your order will be set out on the “CHECKOUT” page prior to proceeding to the “PAYMENT” page. After the authorisation of your debit card or credit card, we will send you an email confirming receipt of your order, detailing the products you have ordered together with an order number. This email is not an order confirmation or order acceptance from Millican. We reserve the right to cancel any order and/or refuse access to the website. It is your responsibility to inform us immediately if there are any errors in your order.

3. Product Guarantee

3.1. Millican offers a limited lifetime guarantee against possible defects in materials and craftsmanship of all products. The guarantee starts from the date the product was purchased. In the event of a defect arising during the guarantee period, please contact Millican by email at hello@homeofmillican.com or by telephone on +44 (0)1768 778 778.

3.2. Millican will repair your product, or replace it with a similar product, free of charge. When making a claim, you will need to provide your original dated receipt or invoice from Millican from the store or website where the product was purchased.

3.3. This guarantee does not cover any damage caused by misuse or neglect, accidents, abrasion, exposure to extreme temperatures, solvents, acids, water or normal wear and tear.

3.4. This guarantee does not cover the cost of returning the product to our nominated repairs location.

4. Price & Payments

4.1. The price that you pay for the product will be the price that is displayed on the website at the “CHECKOUT” stage. All final prices are quoted in UK Pounds Sterling and are inclusive of value-added tax (VAT) and our standard delivery charges.

4.2. All purchases are usually invoiced at an amount inclusive of VAT at 20%. Goods shipped outside of the United Kingdom and European Union may be eligible for a VAT refund. Millican will automatically exclude any VAT charges, when permitted by law, based on the country to which the product is to be delivered.

4.3. Any discounts we offer are time limited which will be communicated alongside the discount code and are dependent on product availability. Accordingly, the price of such products may change from time to time. Millican have the right to withdraw from any offers we advertise at any time.

4.4. We will take payment from your debit or credit card after you confirm the “PAYMENT” stage of the order. We accept payment with Visa, Mastercard, Maestro and PayPal. If we are unable to supply the product that you have ordered, we will contact you by telephone and/or e-mail to offer you either a full refund or a substitute product. If we do not receive a response from you within 7 days of our first attempt to contact you, we will refund the total amount we deducted from your debit or credit card.

4.5. We will endeavour to ensure that all prices on our website are accurate. However, pricing errors may occur. If an error is found in the price of the product you have ordered, we will contact you as soon as possible. If a product′s correct price is lower than the price stated on our website, we will charge the lower amount to your debit or credit card and send the product to you. If a product′s correct price is higher than our stated price, then we will give you the option of either continuing with your purchase at the correct price or cancelling the order affected by the error. We will deem the order cancelled if we do not receive a response from you within 7 days of our first attempt to contact you. In such a case, we will refund the total amount we deducted from your debit or credit card.

4.6. For deliveries outside of the UK and the European Union, you may be required to pay import duty, custom charges or other local taxes. Customs policies vary widely from country to country so please contact your local customs office for further information. Please note that the payment of any import duties, customs charges, local taxes or any administration charges paid to couriers in relation to these fees, is for your own account. We work with Global-E to try and ensure you are aware of all possible fees prior to your purchase, these will be shown to you at the PAYMENT stage of your purchase. Millican Outdoor Limited cannot be held responsible for the payment of any of the above mentioned charges.

5. Delivery

5.1. We will attempt to deliver the Goods to the place designated by you in the accepted order, during normal business hours. We may employ a third party company as our carrier to make these deliveries.

5.2. Unless otherwise expressly agreed in writing, any delivery date or time specified by us in any quotation, despatch note or otherwise, is a best estimate only and we will not be liable to you for any loss or damage sustained by you if we fail to meet that timescale because of circumstances beyond our reasonable control.

5.3. The delivery costs, as quoted, are for your account. A delivery charge will be added to your order prior to acceptance, and will be paid by you. For special delivery, please check our DELIVERY section.

6. Risk And Title

6.1. Ownership of the Goods and the risk of damage to the Goods will pass to you upon delivery.

7. Damage Or Loss In Transit

7.1. We shall repair or replace, free of charge, any Goods damaged or lost in transit where delivery has been made by our carrier, provided that you give us written notification of such damage or loss within 7 days of the date of receiving the Goods (so that we may comply with our carrier′s conditions of carriage).

8. Your Right Of Cancellation

8.1. Under the United Kingdom′s Distance Selling Regulations, you have the right to cancel the Contract for the purchase of any of the Goods within 14 working days of delivery. A working day is any day other than weekend and bank or other public holidays.

8.2. We are obliged to exchange the goods or provide you with a full refund provided that, where delivery has taken place, you have returned the Goods to us in the same condition that they were delivered.

8.3. For your own protection, we recommend that you use a recorded delivery service. You are responsible for the cost of returning the Goods to us, unless we delivered the items to you in error or the Goods are faulty.

8.4. If you choose to exercise your right of cancellation after the Goods have been delivered to you, please return the item(s) to Millican, The Shed, Braithwaite Farm, Keswick, Cumbria, CA12 5RY, UK. Wherever possible, you should package the unused goods securely in the original packaging.

8.5. If you do not return the Goods as required by this Contract, we may charge you a sum not exceeding the direct costs of recovering the Goods.

9. Limitation Of Liability

9.1. To the extent permitted by applicable law, in no event will we be liable for any damages arising from or relating to any product purchased from Millican or the use of or inability to use any such product including, but not limited to any loss of use, lost profits, loss or damage to goodwill or business nor for any consequential, indirect or incidental damages.

9.2. To the extent permitted by applicable law, our aggregate liability (whether in contract, tort or otherwise) for any loss or damage shall, in any event, be limited to a sum equal to the amount paid for the product in question.

9.3. This does not include or limit in any way our liability:

9.3.1. For death or personal injury caused by our negligence;

9.3.2. For fraud or fraudulent misrepresentation;

9.3.3. Under section 2(3) of the Consumer Protection Act 1987; or

9.3.4. For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

10. Governing Law

10.1. This Contract is governed by the laws of England and the English courts shall have the non-exclusive jurisdiction to resolve any disputes arising out of or under it.

10.2. No waiver by us of any breach of the Contract by you, is considered as a waiver of any subsequent breach of the same or any other provision.

11. Amendments

11.1. We reserve the right to make changes to these Sale Terms at any time. You will be subject to the Sale Terms in force at the time you place your order with us.
